Products Liability Cases in Oregon
We have successfully handled numerous cases for people seriously injured by dangerous products. Our focus is on helping the inured party receive the compensation and future care that they need. We are also committed to making everyone safer by helping to remove dangerous products from the market.
Products liability claims involve unique issues of fact and law that will determine what parties are legally responsible for causing the injury at issue. Manufacturers, distributors and anyone who alters a product are responsible for designing and manufacturing the product (a drug, medical device, vehicle, construction equipment, etc.) in the safest manner that is reasonably possible. If the product presents any danger to consumers, workers, or the public adequate warnings are required to help avoid injury.
Case StudiesBelow are a few examples of the kinds of products liability claims we have handled recently.
Hip Implant Claims – Stryker, Zimmer, DePuy and Wright Medical
We are currently litigating a large number of claims in Portland and all over Oregon for individuals who have suffered injury because of defective and recalled hip replacement devices. These include the Stryker LFIT Anatomic CoCr V40 Femoral Heads, Rejuvinate, Stryker ABG II, Zimmer Durom Cup, DePuy and Wright Medical implants that have been recalled due to their dangerous design. If you are contacted by your doctor or surgeon about the recall of such a hip replacement device seek their advice immediately.
The Stryker, Zimmer and DePuy metal-on-metal hip recalls occurred because of complaints of pain, swelling, reduced range of motion and difficulty in negotiating stairs. However, whether or not symptoms have developed yet these devices are expected to present serious health problems in the future. These metal-on-metal hip replacement devices are made of chromium and cobalt which has been shown to be toxic in some individuals.
The defective Wright Medical hip implants involve the Conserve and ProFemur titanium devices. The Conserve devices have presented with symptoms and problems similar to the Stryker, Zimmer, and DePuy devices. The Wright ProFemur titanium device is subject to sudden breakage at the joint of the femoral head and stem because of weakening of the titanium alloy used in the device.
